Terms of Service

1. General Provisions
1.1. These Terms of Service ("Terms") govern the use of the GDPRmetrics service available at gdprmetrics.com ("Service").
1.2. The Service is operated by GDPRmetrics, operating in Poland ("we", "us", "our").
1.3. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1.4. These Terms should be read together with our Privacy Policy.
2. Definitions
Service — the GDPRmetrics web analytics platform available at gdprmetrics.com, including the dashboard, API, and tracking script.
User — a natural or legal person who registers for and uses the Service.
Account — a set of resources, settings, and permissions assigned to a specific User.
Subscription — a paid plan that grants access to premium features and higher usage limits.
Merchant of Record — Polar Software Inc., which acts as the authorized reseller of our digital services and handles payment processing, taxes, and billing.
3. Account Registration
3.1. To use the Service, you must create an Account by signing in with Google OAuth. We do not support password-based registration.
3.2. You must provide truthful and accurate information during registration.
3.3. You are responsible for maintaining the security of your Google account used to access the Service.
3.4. Each individual or entity may maintain only one Account unless expressly authorized otherwise.
3.5. You must be at least 16 years old to create an Account and use the Service.
4. Scope of Services
4.1. GDPRmetrics provides GDPR-compliant, cookie-free web analytics delivered as a Software as a Service (SaaS) platform.
4.2. The Service includes a web dashboard for viewing analytics, a lightweight tracking script for website integration, and an API for data access.
4.3. The specific features and usage limits available to you depend on your selected Subscription plan.
4.4. We make reasonable efforts to maintain Service availability but do not guarantee uninterrupted or error-free operation. Scheduled maintenance will be communicated in advance when possible.
5. Subscription Plans and Pricing
5.1. The Service offers the following paid subscription tiers:
- •Hobby — $5/month (up to 20,000 pageviews, 3 domains)
- •Pro — $12/month (up to 100,000 pageviews, 10 domains)
- •Scale — $39/month (up to 1,000,000 pageviews, unlimited domains)
5.2. All prices are in USD and exclusive of applicable taxes. Sales taxes (VAT, GST, etc.) are calculated and collected by our Merchant of Record, Polar Software Inc.
5.3. We reserve the right to change pricing with at least 30 days' notice. Price changes will not affect your current billing cycle.
5.4. Usage limits are soft limits. Analytics tracking is never blocked, but dashboard access may be restricted if usage exceeds 120% of your plan's limit.
6. Payments and Billing
6.1. All payments for the Service are processed by Polar Software Inc. acting as our Merchant of Record. Polar is the authorized reseller of our digital services and handles all payment transactions through Stripe.
6.2. By subscribing to a paid plan, you agree to Polar's Terms of Service as they apply to payment processing.
6.3. Subscriptions are billed monthly. Your subscription automatically renews at the end of each billing cycle unless cancelled.
6.4. Polar handles the calculation and collection of all applicable sales taxes (including VAT, GST, and US Sales Tax) on our behalf as the Merchant of Record.
6.5. We do not directly collect or store your payment card information. All payment data is processed securely by Polar and Stripe.
7. Refunds
7.1. Refunds are handled by Polar Software Inc. as our Merchant of Record, in accordance with their refund policy.
7.2. If you are unsatisfied with the Service, you may request a refund by contacting us at contact@gdprmetrics.com or through Polar's customer support. Refund requests are evaluated on a case-by-case basis.
7.3. We strive to resolve any issues before processing refunds and encourage you to reach out to us first with any concerns.
8. Cancellation and Termination
8.1. You may cancel your Subscription at any time through the Polar customer portal or by contacting us. Upon cancellation, you retain access to your paid features until the end of the current billing period.
8.2. You may delete your Account at any time by contacting us at contact@gdprmetrics.com. Upon deletion, your data will be removed within 30 days.
8.3. We reserve the right to suspend or terminate your Account if you violate these Terms, engage in abusive behavior, or fail to pay subscription fees. We will provide reasonable notice when possible.
8.4. Upon termination, your right to use the Service ceases immediately. Analytics data associated with your Account will be deleted in accordance with our data retention policy.
9. Acceptable Use
You agree not to:
- •Use the Service for any illegal purpose or in violation of any applicable laws
- •Attempt to reverse engineer, decompile, or disassemble any part of the Service
- •Scrape, crawl, or use automated means to access the Service beyond the provided API
- •Intentionally overload or disrupt the Service infrastructure
- •Share your Account credentials or allow unauthorized access to your Account
- •Use the Service to track individuals or collect personally identifiable information
- •Resell, sublicense, or redistribute the Service without our prior written consent
10. Intellectual Property
10.1. The Service, including its design, features, and documentation, is owned by or licensed to GDPRmetrics and protected by applicable intellectual property laws. Certain components are derived from open-source software used under the MIT License. See our Attribution page for details.
10.2. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during the term of your Subscription.
10.3. You retain ownership of all data you input into the Service, including your website analytics data. We do not claim any intellectual property rights over your data.
11. Data and Privacy
11.1. Our collection and use of personal data is governed by our Privacy Policy, which forms an integral part of these Terms.
11.2. You are responsible for ensuring that your use of our analytics tracker on your websites complies with applicable privacy laws, including providing any required notices to your website visitors.
11.3. Our analytics tracker is designed to be GDPR-compliant by default: it does not use cookies, does not collect personal data, and does not track individual users. However, it is your responsibility to verify compliance within your specific regulatory context.
12. Limitation of Liability
12.1. To the maximum extent permitted by applicable law, GDPRmetrics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
12.2. Our total aggregate liability arising from or related to these Terms or the Service shall not exceed the total amount paid by you for the Service during the twelve (12) months preceding the claim.
12.3. These limitations apply regardless of the legal theory on which the claim is based, whether in contract, tort (including negligence), strict liability, or otherwise.
13. Disclaimer of Warranties
13.1. The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
13.2. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.
13.3. Analytics data is collected using statistical sampling and may not represent exact figures. We make reasonable efforts to ensure accuracy but do not guarantee it.
14. Governing Law and Jurisdiction
14.1. These Terms are governed by and construed in accordance with the laws of the Republic of Poland, without regard to conflict of law principles.
14.2. Any disputes arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts of Poland.
14.3. If you are a consumer within the European Union, you also benefit from any mandatory provisions of the consumer protection laws of your country of residence. Nothing in these Terms affects your rights as a consumer under applicable EU law.
15. Changes to Terms
15.1. We reserve the right to modify these Terms at any time. Material changes will be communicated with at least 30 days' notice via email or by posting a prominent notice on the Service.
15.2. Your continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you may cancel your Subscription and stop using the Service.
